Description: The objective of this study is to analyze the Brazilian institutes of "desapropriacao" and "desocupacao" under an updated perspective of the current problems surrounding them, among them the need to respect the social function of property in view of the holder of the rights to compensation for the loss of property it occupies, justifying such an analysis by the need to adapt their interpretation to these assumptions as an element to guide the conduct of the interested parties and the state. Also at the encouragement given by the Brazilian government to urban land regularization for housing purposes or social interest, it is necessary to make sure who is responsible for such assignment.
